If you are planning on photographing people and using those photographs either in your website, a presentation or another type of publication, it's best to have a "model release" form. Writing your own model release form can sometimes seem like a daunting task, particularly if the model or subject is a minor. Let's take a peak at some of the basic "who, what, where, when" information that you will need to cover within your release:
- Photography Company Name & Logo
- Date of Photo Shoot
- Model's Full Legal Name
- Model's Full Signature
- Model's Guardian's Full Legal Name (Minors)
- Model's Guardian's Full Signature (Minors)
- Photographer's Full Legal Name
- Photographer's Full Signature
- Contact Information for all Parties: Address, Phone, E-mail
In regards to the "why" portion of your model release; you should include information pertaining to the purpose behind the model signing the form. For example, you might want to include the following:
- Photographer has permission to photograph subject.
- Photographer has permission to publish, republish or transfer the medium of the images throughout the world.
- Subject is in compliance with the photograph potentially being altered or modified at a later date.
- Subject waives rights to inspect or approve a finished photograph, any copies of the image and how image is used.
- Subject further releases Photographer from any damage, foreseen or unforeseen, that may occur with the use of the images.
- Subject agrees that s/he is of the legal age and has capacity to execute the release.
I would also recommend including a photograph of your model within the form, such as a basic head-shot. By including a photograph within your model release, you will always be able to put the "name to the face" when sifting through paperwork. Some photographers also ask the model to write down their age within a model release form, especially if the model is a minor. There are a lot of online sources that can guide you in the right direction when writing your own model release form.
